The Children’s Cancer Association (“CCA”) is a non-profit organization that strives to fulfill critical needs that are otherwise unmet and to bring joy to young hearts through its various programs and services. One of CCA’s programs is MyMusicRx. www.MyMusicRx.org is an innovative digital platform that delivers music medicine to critically ill kids and teens. MyMusicRx is a social enterprise that offers opportunities to kids and teens who are fighting cancer and other life threatening illnesses by giving them a unique place to listen to music, create playlists of their favorite songs, and tell their stories in online profiles. They can even share how they are currently feeling using the site's colorful Mood Meter. MyMusicRx connects with people's love of music and also raises funds for the Children's Cancer Association through a partnership with iTunes.

Your privacy is important to the Children's Cancer Association (“CCA,” “we,” or “us”). We are strongly committed to protecting your privacy. We want you to understand the types of information we may receive directly from you or automatically through your computer when you access http://www.MyMusicRx.org (“Website” or “Site”), and how we treat your information.

This is our Privacy Policy. We will comply with this Privacy Policy and applicable privacy laws in the United States, including the Children’s Online Privacy Protection Act (COPPA) whenever we gather and/or use information we collect on this Site.

INFORMATION COLLECTION & USE

II. REGISTRATION

Only residents of the United States of America and Canada are eligible to register as users of the Website and create MyMusicRx profiles at this time. To register, we require users to provide certain information, such as: (a) full name; (b) gender; (c) birth date; (d) country; (e) state; (f) hometown; (g) medical diagnosis; (h) user story; and (i) email address, except for visitors who are children under the age of 13 who are asked to provide their parent's or guardian's email address and phone number. For residents of Canada, any information submitted on MyMusicRx or through a registration form will be transmitted, processed and hosted in the United States.

While we will receive specific personal identifying information during the registration process the Website will not disclose more than the MyMusicRx profile name, age, diagnosis, status update, musical choices, user story, and mood meter. CCA is the sole owner of the information collected from our users at several different points on our Website. However, any link to a sponsor site, such as iTunes is not governed by the Privacy Policy of this Website, but by the individual sponsor’s site.

One of our features is prescribing music via the Facebook Connect feature. If you choose to prescribe music and have this posted on the MyMusicRx wall and/or your Facebook Wall you will need to be logged into your Facebook Account. This service gives you the option to post music prescriptions on our site and to share with others within your network on Facebook and/or on MyMusixRx. These services will authenticate your identity and provide you the option to share certain personal information with us such as your name and email address to pre-populate our sign up form. Services like Facebook Connect give you the option to post a music prescription on this Web site and to to share with others within your network on Facebook.

The following registration process applies, depending on the age of the user.

A. Users Under the Age of 13

We require verifiable parental consent before a MyMusicRx profile is created for any child under the age of 13. To ensure that we have parental consent, we require that parents complete a registration form and create their child’s MyMusicRx account. A child’s participation or access to an activity is not conditioned on him/her providing more Personal Information than is reasonably necessary for that activity. Parents/Guardians have the right to consent to the site’s use of their child’s Personal Information without having to consent to its disclosure of that information to third parties by completing the verifiable parental consent form described below.

In order to register a child under the age of 13 to participate in the Website, there are two application procedures:

(1) The child may fill out their profile and upon indicating that they are under 13, pursuant to the Website’s Terms of Use and this Privacy Policy CCA will not allow the child’s profile to go live on the Website until the parent has consented in writing to the MyMusicRx profile and membership. CCA will send the parent a registration form via email or mail depending on the parent’s preference. The consent may either by mailed, faxed or scanned back to CCA.

(2) Parents may download, print, complete and mail, fax or scan and email the registration and parental consent form located at http://www.MyMusicRx.org/register/kid/ to CCA. During registration you are required to provide contact information (such as name and email address). Once we receive the signed registration and parental consent form, , you may create your child’s MyMusicRx profile.

Again, we do not allow any child’s MyMusicRx profile to go live on our site until it has been reviewed and approved by CCA pursuant to our Terms of Use. Once you have created your child’s MyMusicRx profile, it may be updated from time to time with status updates, new musical choices, photos, changes in medical diagnosis, and mood, the profile will be viewable by outside third party users. Any updates to your child’s MyMusicRx profile will not go live onto the Website until they have been approved by CCA pursuant to our Terms of Use . In addition, parents/guardians may at any time review any identifiable information collected about their child through the Parental Access policy below.

Once a child’s profile is approved, they may download the PC software game JamParty, to play with on their PC computer as well as other games made available.

B. Users Over the Age of 13

Persons between the ages of 13 and 17 should ask their parents to review this policy. All users may contact our privacy team at: questions@MyMusicRx.org with any questions or concerns.

Artists have the ability to upload video and audio greetings through a custom upload tool on www.MyMusicRx.org CCA will review all greetings to ensure they appropriately meet the needs of the community before posting them for both registered MyMusicRx kids and sometimes all website users to access the greetings.

III. Uses of Information

A. Use of Profile MyMusicRx

We use personal identifying information to communicate with registered users. We also permit registered users to post personal information on our MyMusicRx Kids page, including but not limited to biographical information, medical condition, status updates, mood updates, and photographs. Parents have complete control over their own and their children’s information.  Content uploaded on our MyMusicRX Kids page is subject to the Terms and Conditions of Use.

B. Law Enforcement and Safety

We reserve the right to disclose your personally identifiable information as required by law and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process served on our Website. By registering for a MyMusicRx profile, you acknowledge, consent and agree to the extent legally permissible in a jurisdiction that we may access, preserve, and or disclose the information we collect in Section II or other information and/or content to a law enforcement agency or another third party if required to do so by law or in good faith belief that such access, preservation, or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce the Terms of Use; (c) respond to claims that content violates the rights of third parties; (d) respond to your requests of customer service; or (e) protect the rights, property, or personal safety of the CCA, or any users of the Website. We may also disclose user information whenever we believe disclosure is necessary to limit our legal liability; to protect or defend our rights or property; or protect the safety, rights or property of our visitors or others.

C. Information Sharing and Disclosure

We do not link aggregate user data with personally identifiable information.

D. Personally Identifiable Information

The personally identifiable information that you provide to us to, among other things:

  • Operate and improve our Website, program and services. Unless a parent submits a form to delete personally identifiable information, we may keep a MyMusicRx profile data for a reasonable period.
  • We may use your mail or e-mail address to send you updates about special features by select artists, new songs, free downloads and applications.
  • Send you business communications regarding notices, updates, and administrative messages.
  • Detect, prevent and enforce against fraudulent, malicious or illegal acts.
  • Process your entries, if any, to run sweepstakes, contests programs and surveys.
  • Meet legal, regulatory, insurance security and processing requirements.
  • For other purposes required by law.
  • We do not share your personal information with any outside third parties who are trying to market or sell you products. However, we reserve the right to share aggregate information with third party research companies.

We may share information that does not directly identify you. This information may be in aggregated or anonymized form.  Any "User Content" (as defined by the Terms of Use), uploaded on our MyMusicRx Kids page is subject to the Terms and Conditions of Use .  User Content may be utilized to promote MyMusicRX and the CCA on this website, and in other mediums, including but not limited to, Facebook, Twitter, news articles, and advertisements.

 

 

We may transfer personally identifiable information to third party vendors, consultants and other service providers ("Vendors") such as marketing partners in order to operate and improve the Website or to create content to promote MyMusicRX and CCA. Our Vendors will use your information to do work for us, and will not share your personally identifiable information in a manner that violates this Privacy Policy and they are not permitted to use this information for their own marketing purposes.

E. Log Files

As is true of most Web sites, we gather certain information automatically and store it in log files. This information includes internet protocol (IP) addresses, browser type, internet service provider (ISP), referring/exit pages, operating system, date/time stamp, and clickstream data.

We use this information, which does not identify individual users, to analyze trends, to administer the site, to track users’ movements around the site and to gather demographic information about our user base as a whole.

We do not link this automatically-collected data to personally identifiable information. We use a third-party tracking service called Google Analytics that uses cookies to track non-personally identifiable information about visitors to our site in the aggregate to help us track usage on the Site.

F. Cookies and Clear Gifs

A cookie is a small text file that is stored on a user’s computer for record-keeping purposes. We use cookies on this site. We do not link the information we store in cookies to any personally identifiable information you submit while on our site.

We use session ID cookies to make it easier for you to navigate our site. A session ID cookie expires when you close you browser.

If you reject cookies, you may still use our site, but your ability to use some areas of our site, such as contests or surveys, will be limited.

We and our third party advertising partner employ a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs), that help us better manage content on our site by informing us what content is effective. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies, which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on Web pages and are about the size of the period at the end of this sentence. We do not tie the information gathered by clear gifs to our customers’ personally identifiable information. We do not have access or control of third party tracking technologies.

This privacy statement covers the use of tracking technologies by CCA on this Site and does not cover the use of cookies by any advertisers.

G. Third Party Advertisers

While we do not have sponsored ads on our Website, we do show music offered by Apple’s iTunes store. The information about the iTunes store is delivered to users by Apple, our advertising partner. We share aggregate Website usage information about users with Apple.

Apple uses cookies on this site, which allow it to recognize a user's cookie when a user visits this site. The information that Apple collects and shares through this technology is not personally identifiable.

IV. Communications from the Site

A. Customer Service

Based upon the personally identifiable information you provide us, we will send you a welcoming letter. We will also communicate with you in response to your inquiries, to provide the services you request, and to manage your account. We will communicate with you by email or telephone, in accordance with your wishes.

B. Profile

We store information that we collect through cookies, log files, and/or third party sources to create a “profile” of your preferences. We do not tie your personally identifiable information, to information in the profile, in order to provide tailored promotions and marketing offers and to improve the content of the site for you.

We share your profile with other third parties in aggregate form only.

C. Email Updates

By email we will occasionally send you and your child information about CCA events, volunteer opportunities, or updates on featured music and/or musicians.

Out of respect for your privacy, we present the option not to receive these types of communications. Please see the “Choice and Opt-out” section below.

D. Service-related Announcements

We will send you strictly service-related announcements on rare occasions when it is necessary to do so. For instance, if our service is temporarily suspended for maintenance, we might send you an email.

Generally, you may not opt-out of these communications, which are not promotional in nature. If you do not wish to receive them, you have the option to deactivate your account.

V. Surveys or Contests

From time-to-time we may provide you the opportunity to participate in contests or surveys on our site. If you participate, we will request certain personally identifiable information from you. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes contact information (such as name and shipping address), and demographic information (such as zip code).

We may use this information to notify contest winners and award prizes, to monitor site traffic or personalize the site (in the case of anonymous information collected in surveys).

A. Reviewing your Information

You have the right to access, update and correct factual inaccuracies to your personally identifiable information that we collect online at our Website, subject to certain exceptions. When setting up the account of a child under 13, parents/guardians sign a form that allows them to review any identifiable information collected from their child, have this information deleted, and/or request that there be no further collection or use of their child’s information by email, fax or phone. For children 13 and over, parents/guardians can download the form allowing them to view, edit and close a MyMusicRx account here: http://www.MyMusicRx.org/register/kid/, print out the form and either mail, fax or scan and email us a signed form.

VII. NOTICE – CALIFORNIA RESIDENTS

Website users that are California residents may request certain information regarding the CCA’s disclosure of personal information to third parties for direct marketing purposes. The CCA will not share your personal information with third parties for direct marketing purposes without first seeking your approval.

VIII. Choice/Opt-out

We provide you the opportunity to ‘opt-out’ of having your personally identifiable information used for certain purposes, when we ask for this information.

If you no longer wish to receive our email updates or promotional communications, you may opt-out of receiving them by following the instructions included in each communication or by emailing us at: questions@MyMusicRx.org.

You will be notified if your personal information is collected by any third party that is not our agent/service provider, so you can make an informed choice as to whether or not to share you r or your child’s information with that party.

IX. Security and DATA RETENTION

The security of you and your child’s personal information is important to us. When you enter sensitive information on our registration or order forms, we encrypt that information using secure socket layer technology (SSL).

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it. No method of transmission over the Internet, or method of electronic storage, is 100% secure, however. Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

We will retain you and/or your child’s information for as long as your account is active or as needed to provide you services. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

X. Business Transitions

In the event CCA goes through a business transition, such as a merger, acquisition by another company, or sale of all or a portion of its assets, your personally identifiable information will likely be among the assets transferred. If we make material changes to how we use Personal Information collected from children under age 13, we will notify parents/guardians by email in order to obtain verifiable parental consent for the new uses of the child’s Personal Information.
